Only three of these are decisions. The fourth is what happens when nobody is tracking the date, and it is the most common outcome.

Standard confirmation letter format

Eight elements. The letter is short, and its value is that it fixes a date and states what changes.

  1. Header. Employee name, code, designation, department, and date of the letter.
  2. The background. Date of joining, probation period, and the clause of the appointment letter it was set under.
  3. The decision. That the employee is confirmed, stated plainly.
  4. Effective date. The date confirmation takes effect from, which is ordinarily the day after probation ends.
  5. What changes. Notice period above all, and any entitlement that begins on confirmation.
  6. What does not change. That the remaining terms of the appointment letter continue unaffected.
  7. Any revision. Where confirmation coincides with a pay revision, the revised figures or a reference to the annexure.
  8. Acknowledgement. A signature block, and a copy filed against the employee record.

Keeping confirmation and pay revision separable is worth doing deliberately. Where the two are always issued together, an employee confirmed without a revision reads it as a negative signal that was never intended.

What it has to contain

How to write one

  1. Diarise the probation end date at joining. Set the reminder when the appointment letter is issued, not when someone remembers. Every problem on this page follows from the date arriving unnoticed, and it is the only step that prevents all of them.
  2. Set the confirmation criteria at induction. Tell the person at the start what confirmation depends on. A probation assessed against expectations the employee was never given is not an assessment, and a decision to extend or refuse on that basis is difficult to defend.
  3. Review before the end, not at it. Hold the review far enough ahead that an extension or a non-confirmation can be issued before the original period expires. Reviewing on the last day removes every option except confirming.
  4. Raise concerns during probation, in writing. Anything relied on in a decision to extend or refuse should have been put to the employee while there was still time to act on it. Concerns appearing for the first time in the decision letter look like reasons found afterwards.
  5. Decide deliberately, including when confirming. Confirmation should be an act, not the absence of one. Where the manager has no view, that is a sign the expectations were never set, and it is worth fixing before the next hire rather than after.
  6. Issue the letter and file it. Confirmation held as a decision in someone's mail is not on the record. The signed letter goes against the employee record, and the notice period field is updated at the same time.
  7. Keep confirmation separable from pay revision. Where the two are always issued together, confirmation without a revision reads as a negative signal. Decide each on its own basis and, where they coincide, present them as separate paragraphs.

Why confirmation by default is the usual outcome

Ask an organisation how many probations it confirmed last year and it will usually be able to answer. Ask how many it actively decided to confirm, and the number is smaller.

The mechanism is mundane. The probation end date is recorded in the appointment letter and nowhere else. The reporting manager has no reminder. The date passes, the employee keeps working, payroll keeps paying, and some months later someone notices that no letter was ever issued. By then the person has been treated as a confirmed employee for a period, and the practical position is that they are one.

The cost is not usually large, but it is real. The employer has lost the shorter notice period that applies during probation. Any decision it might have made, to extend or to part company, was never available. And the message to the employee is that the organisation was not paying attention, which is a poor first impression of how performance is handled.

The fix is administrative rather than legal: record the probation end date as a date on the employee record, set a reminder several weeks ahead, and require the manager to record an outcome. Organisations that do this find that a proportion of probations they would have confirmed by default are ones they wanted to discuss.

Extending probation properly

Extension is legitimate and often the right answer. It goes wrong in two specific ways, both avoidable.

The first is timing. An extension has to be decided and communicated before the original period expires. Once the date has passed without a decision, the person has ordinarily been treated as confirmed, and a letter arriving afterwards is attempting to reopen something that has closed. If the date has been missed, the honest course is to accept the confirmation and use the performance process for whatever the concern is.

The second is content. An extension letter that says progress has not been satisfactory and grants three more months tells the employee nothing they can act on. They know they are being watched and do not know what would satisfy the watcher, which tends to make performance worse rather than better.

A workable extension letter states which areas were satisfactory, which were not, and what was observed in each. It then states what specifically has to be demonstrated and by when, what support the employer will provide, when the interim review happens, and what follows in each direction. That is a short document, and it is the difference between an extension that resolves something and one that postpones the same conversation.

What probation does and does not change

Probation is widely understood as a period in which the employer can act freely. That is an overstatement, and organisations relying on it are the ones most often surprised.

What probation does is shorten the notice period, and defer any entitlement the appointment letter or policy makes conditional on confirmation. Both of those are creatures of the contract, and they operate as the appointment letter provides.

What it does not do is remove the need for a reason, or release the employer from a process it has bound itself to. Where the appointment letter or the disciplinary policy sets out a procedure, that procedure applies during probation as much as after it. Departing from your own published process is easy for an employee to point at, whatever their status.

Nor does probation suspend the other obligations of employment. Statutory entitlements apply according to their own terms, not according to whether someone has been confirmed. An employee on probation who raises a concern about harassment, safety or pay is entitled to the same treatment as anyone else.

The practical implication for the letter is that a non-confirmation should still record what was assessed, what was raised during the period, and what the employee said. That costs nothing when the decision is sound, and it is the only thing that helps when it is questioned.
